Requirements for a Transparency Declaration:
A transparency declaration is required when an application is made to register an interest in land as defined in LOTA. Filings are required to be submitted electronically by a legal professional.
An interest in land is defined in LOTA as any of the following:
- an estate in fee simple,
- a life estate in land,
- a right to occupy land under a lease that has a term of more than 10 years,
- or a right under an agreement for sale to occupy the land or require the transfer of an estate in fee simple.
To begin a filing from any page of the LTSA's Electronic Filing System, roll over Submissions and click Land Owner Transparency Registry:
Then select Go to LOTR Filings:
LOTR has a functionality to help determine the appropriate form(s) to submit.
Clicking on + Create New Record prompts users to select from four scenarios and depending on the selection made either a transparency declaration or a transparency report will be created.
Experienced users can bypass the functionality by clicking on the drop down arrow beside the button and selecting the required form.
