Property Owner Credential Terms of Use

(Appendix E to the LTSA Customer Agreement)

These Terms of Use form part of the LTSA Customer Agreement and apply to your use of a Property Owner Credential (as defined below) issued by LTSA. By applying for, accepting, or using the Credential, you agree to be bound by these Terms of Use and the LTSA Customer Agreement. Capitalized terms not otherwise defined in these Terms of Use have the meanings given to them in the LTSA Customer Agreement.


Definitions. In these Terms of Use:

(a)"Land Title Register" means the BC Land Title Register maintained by LTSA.
(b)"Property" means the property in respect of which the Property Owner Credential is issued.
(c)"Verifiers" means third parties to which you present your Property Owner Credential to allow those third parties to verify that you are the registered owner of the Property.
(d)"Property Owner Credential" means a digital credential issued to you to enable you to prove your ownership of the Property to Verifiers.
(e)"Wallet" means a digital wallet application approved by LTSA that you can use to receive, store and present your Property Owner Credential.

Eligibility and Acceptance. To accept these Terms of Use and have the Property Owner Credential issued to you, you must:

(a)be a natural person (i.e. not a company or other legal entity);
(b)be the registered owner of the Property in the Land Title Register; and
(c)have an Account with LTSA and agree to the terms and conditions of the Customer Agreement.

Creation and Issuance of Property Owner Credential. Following receipt of a request from you for a Property Owner Credential, LTSA may:

(a)use information provided by you to verify ownership information in the Land Title Register and create the Property Owner Credential; and
(b)issue the Property Owner Credential to your Wallet.

Presentation of Property Owner Credential. Subject to section 9, you are solely responsible for deciding which Verifier(s) you will present the Property Owner Credential to and what information to share with Verifiers. Verifiers will be able to independently confirm whether the Property Owner Credential is valid or has been revoked.


Acceptable Use. You are solely responsible for all use of the Property Owner Credential. You must not:

(a)share your Property Owner Credential or allow any other individual or entity to access or use it, other than your authorized legal or personal representative or as otherwise permitted by LTSA;
(b)attempt to add the Property Owner Credential to a digital wallet or other application that has not been approved by LTSA for such use;
(c)use your Property Owner Credential for any purpose other than to verify your ownership of the Property or such other uses approved by LTSA from time to time;
(d)use or attempt to use any Property Owner Credential that has been revoked;
(e)tamper with the Property Owner Credential; or
(f)attempt to circumvent or subvert any security measure associated with the Property Owner Credential.

Wallet and Device Protection. You are responsible for the security of any Wallet that you use in connection with the Property Owner Credential and of the device or service that holds the Wallet, including without limitation for using appropriate device protection and for keeping your device protection confidential, as well as for using appropriate security protections in connection with your device.


Loss or Compromise of Credential. You must immediately notify LTSA if your Property Owner Credential, or the device on which it is stored, is lost, stolen or otherwise compromised.


Ownership and License. The Property Owner Credential is owned by LTSA. Subject to your compliance with these Terms of Use and the Agreement, LTSA grants you a non¬exclusive, revocable, limited license to access and use the Property Owner Credential for the purpose of allowing Verifiers to which you choose to present the Property Owner Credential to verify your registered ownership interest in the Property.


Policy Guidance and Further Requirements. LTSA may, from time to time, issue policies, instructions, guidance or requirements governing the use of the Property Owner Credential, including guidance respecting intended Verifiers or restrictions on use. Any such instructions, guidance or requirements that are published or otherwise made available by LTSA form part of these Terms of Use and are binding on you.
